These Terms of Use (“Terms”) govern the use of the websites goovalid.com and app.goovalid.com (“Site”) and the digital services offered through them (“Services”). Any individual or entity accessing the Site or using the Services (“User”) is deemed to have read, understood, and accepted these Terms in full. If you do not agree with these Terms, you must not access or use the Site or the Services.
This Agreement becomes effective as of the date you first access the Site or begin using the Services (“Effective Date”) and will remain in effect until terminated as described herein. These Terms apply to all present and future use of the Services, unless superseded by separately executed commercial terms, which, in the event of conflict, shall prevail.
The Services provided through the Site include digital identity verification, validation tools, security solutions, and related products made available online. Access to the Services is granted to the User’s account immediately upon registration or, where applicable, once the payment process is completed. Some Services may require payment through third-party payment providers such as PayTR. By completing a transaction, the User also agrees to comply with the terms of use and privacy policies of such providers.
The Site is intended for individuals who are at least 18 years of age. By creating an account, the User represents and warrants that they meet the age requirement, that they are acting on their own behalf or as a duly authorized representative of a legal entity, and that all information provided during registration is accurate, complete, and up-to-date. Users are responsible for maintaining the confidentiality of their account credentials and must notify Goovalid immediately in the event of any unauthorized access or suspected misuse. Users are solely liable for all activities conducted under their accounts.
Due to the digital nature of the Services, access is considered delivered immediately upon registration or completion of the purchase. Therefore, under Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, the User does not have the right to withdraw or cancel once digital content or services have been delivered. Similarly, under Article 16(m) of Directive 2011/83/EU applicable to consumers within the European Union, the right of withdrawal is waived once the User explicitly consents to immediate delivery of digital content. By registering or completing a purchase, the User acknowledges and accepts that they have no right of withdrawal.
All content, software, source code, visuals, algorithms, and digital materials provided through the Site are protected under applicable intellectual property laws. Goovalid exclusively holds all ownership and copyright rights. The Services and related content may not be copied, modified, reproduced, distributed, sublicensed, made available to third parties, or used for commercial purposes without prior written permission from Goovalid. Any unauthorized use constitutes a violation of intellectual property rights, including Turkish Law No. 5846 on Intellectual and Artistic Works, and may result in civil and criminal liability. The Services are licensed only to the registered User for personal or authorized business use.
Users agree to use the Site and Services in compliance with all applicable laws and these Terms. Users must not upload, transmit, or use the Services for unlawful, fraudulent, misleading, or harmful purposes. Accounts of Users who violate these Terms, misuse the Services, or engage in activities harmful to the Site, other Users, or third parties may be suspended or terminated at Goovalid’s sole discretion. Goovalid also reserves the right to take legal action in such cases.
The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Goovalid does not guarantee that the Site or Services will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, Goovalid disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of or inability to use the Site or Services.
Users agree to indemnify and hold harmless Goovalid, its affiliates, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to their use of the Services, violation of these Terms, or infringement of any third-party rights.
The Site may contain links to external websites or integrate with third-party services. Such websites are outside the control of Goovalid, and Goovalid assumes no responsibility for their content, practices, or security. By accessing such third-party sites, the User agrees to be subject to their respective terms of service and privacy policies.
This Agreement will remain in force until terminated by either party. Users may terminate their use at any time by closing their accounts; however, any prepaid fees are non-refundable. Goovalid may suspend or terminate accounts with immediate effect if the User breaches these Terms or misuses the Services. Upon termination, all licenses granted to the User will immediately expire.
During the course of using the Services, Users may gain access to confidential or proprietary information of Goovalid. Users agree to maintain the confidentiality of such information and not to disclose it to any third party without prior written consent.
These Terms, together with any applicable commercial terms, constitute the entire agreement between the User and Goovalid and supersede all prior agreements, representations, or
understandings. No waiver of any provision shall be effective unless made in writing. Users may not assign or transfer their rights or obligations under this Agreement without Goovalid’s prior written consent.
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of Istanbul Central (Çağlayan) Courts and Enforcement Offices.
All notices and communications under these Terms shall be delivered electronically via the email address provided by the User at registration or via updates published on the Site.
